The European Commission has decided to initiate proceedings against the Croatian in accordance with Article 39 of the Croatian accession treaty and it will soon inform the Member States. On Friday, Commissioner Viviane Reding , responsible for Justice and Stefan Fuele charge of Enlargement Commissioner informed the course of Croatian violation of the European arrest warrant and they got the support of the Commission to activate Article 39.
Soon, the Commission will inform the Member States, because Article 39 provides consultation with the Member States , but do not need their approval to launch protective measures . Member States shall have ten days to answer about it, and then will decide what measures shall be taken against the Croatian.
Diplomatic sources said that it will most likely be a denial of the money used for the preparation for entry into the Schengen area . An alternative would be introduce of monitoring , against which the Commission objected before the Croatian accession to the EU.
